TUPE of BT Facilities to CBRE and ISS – Formal Consultation Continues

A further meeting was held with BT, CBRE and ISS on Wednesday 16 January 2019 to continue consultation on the terms of transfer for all CWU grades currently working in BT Facilities Services to CBRE and ISS from April 2019.

The CWU are discussing the standard contractual, non-contractual terms and conditions as well as benefits that will transfer, and whilst this may be in theory a straight forward exercise, it is complicated by the fact that there are a myriad of different terms and conditions and contractual terms that apply as a result of the numerous transfers that have taken place over the years.

Therefore it is important to ensure such issues for example as allowances, annual leave, working hours, sickness benefit and pension contributions are correct depending on the particular contract that BT Facilities Services employees are working on.

Whilst progress has been made there are still a number of issues that are under discussion.

However, I would like to clarify 2 issues in particular where it appears that emails are circulating from BTFS managers.

  1. BT Redundancy K020 – Former Telereal employees

The CWU is aware that a statement has been circulated by BT regarding the contractual status of the redundancy terms as contained in EMP/K020 that specifically covers the people who TUPE transferred to and from Telereal.  The CWU has challenged this statement and have informed BT that we believe the statement is incorrect and the K020 should transfer for the following reasons:

  • K020 is a collective redundancy agreement with the CWU.
  • Telereal accepted on transfer that the k020 was contractual and it was accepted by BT when those employees transferred back in.

Discussions are ongoing.

  1. Broadband Benefits

BT has stated that the current benefit that the BT/BTFS employees have to access the BT broadband and BT Vision (TV) for a one-off charge of £1.50 will no longer be available post transfer from 01 April 2019.

The CWU are currently in discussion on what ongoing compensation payments will apply and have at this stage not agreed to any amount of compensation.  It is the view of the CWU that any compensation should be ongoing for those currently in receipt of this benefit and should take into consideration the actually amount that an individual would need to buy this package as a customer.

CWU Objectives

In addition to the formal consultation on the TUPE matrix the CWU have a number of meetings in the diary to discuss the issue of collective bargaining, job security and the CWU objectives.

To remind Branches of the campaign objectives I have reproduced these below:

  • To campaign against the outsourcing of BT Facilities Services.
  • To oppose any compulsory redundancies and to agree improved voluntary terms for any job losses.
  • To protect the existing terms and conditions of employment including;

i) at the minimum maintaining the Real Living Wage for housekeepers and Security Officers.

ii) the protection of contractual hours.
